globe-sim-registration.ph (“Site,” “we,” “us,” “our”) respects the intellectual property rights of others and expects our users to do the same. This Digital Millennium Copyright Act (“DMCA”) Policy explains our procedures for handling claims of copyright infringement in compliance with the DMCA (Title 17, United States Code, § 512). It also outlines your rights and responsibilities when submitting a takedown notice or counter‑notice. Please read this policy carefully; using our Site implies acceptance of its terms.

1. Introduction & Purpose

The DMCA provides “safe harbor” protections for online service providers (“OSPs”) who, upon receiving proper notice, promptly remove or block access to infringing materials. These provisions shield OSPs from liability for copyright claims arising from user content, provided they implement procedures for receiving and responding to infringement notices. Although Globe SIM Registration primarily hosts our own original content and does not allow user uploads, we may occasionally display third‑party material under fair use (e.g., logos, screenshots or excerpts). To uphold copyright laws and maintain safe‑harbor eligibility, we have established the following policy:

  • Designate a DMCA agent to receive notices.

  • Describe how rights holders can submit valid takedown notices.

  • Explain our process for removing or disabling access to allegedly infringing content.

  • Provide instructions for submitting counter notices.

  • Outline our repeat infringer policy and other related procedures.

2. Designated DMCA Agent

In accordance with 17 U.S.C. § 512(c)(2), Globe SIM Registration has appointed a designated agent to receive notifications of claimed copyright infringement. All DMCA notices and counter notices must be submitted to this agent:

3. Submitting a DMCA Takedown Notice

If you believe that material on our Site infringes your copyright, you (or your authorized agent) may file a written DMCA takedown notice. Under Section 512(c)(3), a valid notice must include the following elements:

  1. Signature: A physical or electronic signature of the copyright owner or authorized agent. Identify whether you are the owner or acting on behalf of the owner.

  2. Identification of the Work Infringed: Clearly identify the copyrighted work(s) claimed to be infringed. If multiple works are involved, you may provide a representative list.

  3. Identification of the Infringing Material & Location: Describe the infringing material and provide the URL(s) or other information sufficient for us to locate it. You may attach a screenshot or copy of the infringing material.

  4. Contact Information: Provide your name, address, phone number and email address so we can contact you.

  5. Good‑Faith Belief Statement: Include a statement that you have a good‑faith belief that use of the material is not authorized by the copyright owner, its agent or the law.

  6. Accuracy & Authority Statement: Include a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Submission Process

  • Send Notice to DMCA Agent: Email your notice to admin@globe-sim-registration.ph. If necessary, mail or fax the notice to the address above.

  • Verification: We review notices for completeness. Notices missing any required element may be disregarded.

  • Acknowledgment: We will confirm receipt via email or mail.

  • Action: Upon verification, we will promptly remove or disable access to the allegedly infringing material.

  • Notification: We will notify the person responsible for the material (if identifiable) that the content has been removed, provide them with a copy of your notice, and inform them of their right to submit a counter notice.

We may request additional information to confirm the legitimacy of your claim or to better identify the infringing material. Please respond promptly to any follow‑up requests to avoid delays.

4. Misrepresentation & Penalties

Section 512(f) of the Copyright Act imposes liability for material misrepresentation. Knowingly misrepresenting that material or activity is infringing can result in damages, including costs and attorneys’ fees. Similarly, providing false information in a counter notice can lead to legal consequences. Do not use the DMCA process for personal disputes or non‑copyright issues.

5. Submitting a DMCA Counter Notice

If you receive notice that your content has been removed due to a DMCA complaint and believe that the removal was erroneous or that you have the right to use the content, you may submit a counter notice. Section 512(g)(3) requires that a counter notice include:

  1. Signature: A physical or electronic signature of the subscriber.

  2. Identification of the Removed Material: Describe the material that was removed and indicate the URL or location where it appeared prior to removal.

  3. Contact Information: Provide your name, address and telephone number.

  4. Good‑Faith Belief Statement: Include a statement under penalty of perjury that you have a good‑faith belief the material was removed due to mistake or misidentification.

  5. Consent to Jurisdiction & Service of Process: Include a statement consenting to the jurisdiction of the Federal District Court for the district where your address is located (or, if outside the U.S., to the appropriate court) and that you will accept service of process from the person who filed the original DMCA notice.

Counter Notice Process

  • Submission: Send your counter notice to our DMCA agent at admin@globe-sim-registration.ph. You may also mail it to our physical address.

  • Forwarding to Complainant: Upon receiving a valid counter notice, we will forward it to the original complainant.

  • Restoration of Content: We will restore the removed content 10–14 business days after forwarding the counter notice, unless the complainant files a court action seeking a court order to restrain you from engaging in the infringing activity.

  • Disclosure: By submitting a counter notice, you consent to the disclosure of your contact information to the complaining party.

6. Safe Harbor & Service Provider Responsibilities

DMCA Safe Harbor Overview

The DMCA safe harbor provisions protect online service providers from monetary liability if they follow specific requirements. These include removing or blocking infringing materials upon receipt of valid notice, designating a DMCA agent and registering the agent with the U.S. Copyright Office. Safe harbor does not guarantee immunity; it simply limits liability when requirements are met. Globe SIM Registration is committed to upholding these provisions, even though we do not host user-submitted content.

Procedures Beyond Removal

  • Agent Registration: We have registered our DMCA agent with the U.S. Copyright Office as required for safe‑harbor eligibility.

  • Notice Handling: We act expeditiously to remove or disable access to infringing material upon receiving compliant notices.

  • Policy Availability: We publish this policy to inform users and rights holders of our procedures. Simply copying a DMCA policy from another site is insufficient; we actively implement the safe‑harbor procedures.

  • Repeat Infringer Policy: We maintain procedures for addressing repeat infringers (see Section 7).

7. Repeat Infringer Policy

Although we do not host public uploads, our policy includes a repeat infringer provision. If we receive multiple valid infringement notices against the same user, or if a user repeatedly posts infringing material in violation of our Terms of Use, we may take the following actions:

  • Account Termination: If the user has an account (e.g., forum or newsletter subscription), we may terminate it.

  • Access Restriction: We may block IP addresses or restrict further access to our Site.

  • Documentation: We maintain records of notices and counter notices to identify repeat offenders and take action when necessary.

8. Fair Use & Transformative Content

Some uses of copyrighted material qualify as “fair use.” U.S. copyright law allows limited reproduction for purposes such as commentary, criticism, education and research. Globe SIM Registration may include:

  • Screenshots of registration pages to explain procedures.

  • Excerpts from legal statutes to inform users about their rights.

  • Logos, trademarks or product images to help users identify official portals.

Our use of third‑party content is transformative—we add commentary, analysis or educational context. Such use is made without intent to infringe, but rather to inform the public. If you believe material posted on our Site exceeds fair use, please contact us via the DMCA procedure above.

9. Technical Measures & Prohibited Circumvention

We implement security and technological measures to protect our Site and intellectual property. Do not attempt to circumvent any security features. Circumvention of technological protection measures may violate laws beyond the DMCA, including anti‑circumvention provisions of Section 1201 of the Copyright Act. We may update this DMCA Policy to reflect changes in the law, legal interpretation or our practices. When we update the policy, we will revise the “Effective Date” at the top of the document.
